Sofia Vergara and her ex-fiancé Nick Loeb have been in the news lately in a battle over their frozen embryos.
This morning I was a guest on Canada AM to discuss the case and shed light on who would likely be the winner in this battle. There is some precedent in California, but we haven’t had any case law yet in Ontario. Are the embryos more like children, in which custody is awarded, or are they more like property, in which case ownership is awarded? Should one person be able to use them without the other person’s consent? What about child support? Would the genetic parent who didn’t want to use the embryos have to pay child support?
